Accounts

When you create an account on our Website, you guarantee that you are 18 years of age or older and that the information that you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Website.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Website or a third party service. Governing law, severability, dispute resolution, venue and class action waiver

These Terms shall be governed and construed in accordance with the laws of Finland, without regard to its conflict of laws provisions. THESE TERMS SHALL NOT BE GOVERNED BY THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE SALE OF INTERNATIONAL GOODS, THE UNIFORM COMMERCIAL CODE, NOR INCOTERMS.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and us regarding our Website, and supersede and replace any prior agreements we might have had with you regarding the Website.

Any controversy or claim arising out of or relating to these Terms including but not limited to the interpretation or breach thereof shall be resolved in a court of competent jurisdiction in Finland.

YOU AND MYLO INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

We reserve the right to make changes to these Terms of Service at any time. We will not provide you with any notice when we make changes to this Terms of Service.

1. About these Terms

These Terms govern your use of SpeakClinic, the website speakclinic.com and the SpeakClinic mobile app (the “Platform”), operated by Mylo Inc., a Philippine corporation (SEC Registration No. 2023070109297-16), Unit 1206 Trade and Financial Tower, 7th Ave. cor. 32nd St., BGC, Taguig City 1635, Philippines (“Mylo”, “we”, “us”). By creating an account or booking an appointment you agree to these Terms and to our Privacy Policy.

2. What SpeakClinic is, and what it is not

SpeakClinic is a technology platform that lets parents, guardians and patients find, book and pay independent therapists and doctors (“Clinicians”) for online, in-clinic and home-service appointments.

  • Mylo is not a health care provider. Clinicians are independent professionals, not Mylo employees. Each Clinician is solely responsible for the care, advice, diagnosis and treatment they provide.
  • SpeakClinic is not for emergencies. If you or your child needs urgent help, call 911 or go to the nearest emergency room.
  • Content on the Platform is general information, not medical advice.

3. Accounts

  • You must be 18 or older to create an account. Parents and legal guardians create accounts for children and are responsible for the child’s use of the Platform.
  • Keep your login details confidential and tell us immediately at customerservice@speakclinic.com if you suspect unauthorised use.
  • Give accurate information. You can close your account at any time in the app or by emailing us.

4. Clinicians

Clinicians who join the Platform confirm that they:

  • hold a valid licence or registration for their discipline in the place where they practise (for the Philippines, a current PRC licence where required) and will keep it current;
  • comply with the professional, ethical and telehealth rules that apply to them, including record-keeping and patient confidentiality;
  • act as controllers of the clinical records they create and comply with the Data Privacy Act, and GDPR where it applies;
  • set their own fees and cancellation terms and display them to patients before booking.

US-based Clinicians who are covered entities under HIPAA must sign Mylo’s Business Associate Agreement before using the Platform with US patients.

We verify licences at onboarding but do not supervise clinical care. We may suspend a Clinician who breaches these Terms.

5. Bookings, payments and refunds

  • Fees are set by each Clinician and shown before you confirm a booking. Payments are processed by our payment partner Xendit; we do not store your card details.
  • Mylo collects the payment on the Clinician’s behalf and may charge a platform fee, which is shown at checkout.
  • Cancellations and refunds follow our Refund & Cancellation Policy and the Clinician’s terms. This does not limit any refund right you have under the Consumer Act of the Philippines or other mandatory law.

6. Teleconsults

For online sessions you need a stable internet connection and a private place. Sessions are not recorded unless both you and the Clinician agree in advance. If a session fails because of a Platform fault, we will help you rebook at no extra cost.

7. Acceptable use

You agree not to: impersonate anyone; upload unlawful, abusive or infringing content; record a session without consent; harass Clinicians, patients or staff; attempt to access other users’ data or our systems without permission; scrape, reverse-engineer or overload the Platform; or use it for anything unlawful.

8. Intellectual property

The Platform, its software, design and content belong to Mylo or its licensors. We grant you a personal, non-transferable, revocable licence to use it under these Terms. You keep ownership of content you upload and give us a licence to use it only to provide the service.

9. Availability

We work to keep the Platform available and accurate but cannot guarantee it will be uninterrupted or error-free. We may change or suspend features, with reasonable notice where the change materially affects you.

10. Liability

  • Mylo is not liable for the professional acts or omissions of Clinicians.
  • To the extent the law allows, Mylo is not liable for indirect or consequential loss, and our total liability to you for any claim is limited to the fees you paid through the Platform in the 12 months before the claim.
  • Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, gross negligence or wilful misconduct, or any right you have as a consumer that cannot be excluded by law.

11. Suspension and termination

We may suspend or close an account that breaches these Terms or puts others at risk, and will tell you why unless the law prevents it. Sections 8, 10 and 13 continue after termination.

12. Changes to these Terms

We will notify you by email or in the app at least 30 days before material changes take effect. If you do not agree, you may close your account before then.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines. Please contact us first so we can try to resolve any issue informally. If that fails, disputes go to the competent courts of Taguig City. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts.
